Terms of Service

These Terms of Service govern access to and use of the SoberAuth website, mobile applications, access control platform, hubs, and related services provided by Advantage Recovery Services LLC. Please read these Terms carefully before using SoberAuth.

1. Acceptance of Terms

By creating an account, joining an organization or facility, accepting an access key, or otherwise using SoberAuth, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use SoberAuth. If you use SoberAuth for an organization, you represent that you are authorized to act in your assigned role.

2. What SoberAuth Provides

SoberAuth is a configurable accountability and access platform for behavioral health organizations in the United States. Depending on the organization's configuration, SoberAuth may provide:

• Organization, facility, administrator, staff, and resident account management.
• Compatible hub and smart lock registration, monitoring, and control.
• Breath test requirements configured by each facility before a door access request.
• Short verification video and a single location capture during an access breath test.
• Access, test, activity, alert, acknowledgment, and operational records.
• Emergency offline access settings for certain hub, server, internet, or power interruptions.
• Operational emails, push notifications, and automated alert escalation calls.

3. Accounts, Roles, and Access Keys

• You must provide accurate account and contact information.
• You must protect your password, session, access keys, and device from unauthorized use.
• You may use only the account and organization or facility access assigned to you.
• Administrators, staff, and residents receive different permissions based on their role and membership.
• You may not share an account, impersonate another person, evade removal, or use an access key without authorization.
• You must promptly notify SoberAuth or your organization if you suspect unauthorized access.

4. Organization Responsibilities

Each participating organization is responsible for:

• Determining who may join its organization and facilities.
• Assigning and reviewing administrator, staff, and resident roles.
• Configuring breath test requirements, BAC access limits, actions after failed tests, relock timing, emergency access, notifications, and escalation settings.
• Maintaining appropriate staffing, physical access, safety, outage, and emergency procedures.
• Providing notices and obtaining permissions or authorizations required by applicable U.S. law.
• Reviewing test, activity, alert, and device information and deciding how its personnel should respond.
• Using SoberAuth in accordance with housing, treatment, employment, licensing, and other requirements applicable to the organization.

5. Breath Tests, Video, and Location

• A facility may require a breath test on every entry, never, or according to a configured random probability.
• The mobile workflow may record a BAC estimate, a short front camera video without audio, and the user's precise location at the time of submission.
• SoberAuth does not currently perform facial recognition or create biometric face templates.
• Users must follow the instructions shown on screen and may not submit another person's test, obscure the verification video, falsify location, manipulate a device, or attempt to bypass a requirement.
• Users must provide the camera, precise location, Bluetooth, nearby device, and other permissions required for the configured workflow.

6. BAC Results and Access Decisions

BAC readings are estimates produced by compatible consumer devices from third parties. They are not medical advice, a diagnosis, or a substitute for evidentiary, legal, employment, or law enforcement testing. A facility may configure its own BAC access limit and its response to a failed test. SoberAuth provides information and automation to apply those settings, but the participating organization remains responsible for its policies, supervision, incident response, and final operational decisions.

7. Locks, Hubs, and External Devices

SoberAuth relies on compatible hardware, software, and networks that may include:

• Smart locks, Z-Wave equipment, local hubs, and supported breathalyzers.
• Mobile operating systems, Bluetooth, GPS, local networks, internet service, and electrical power.
• Email, push notification, voice call, hosting, storage, and video processing providers.

Availability, accuracy, compatibility, and performance may depend on those third parties and may change. Organizations are responsible for following manufacturer instructions, maintaining batteries and network connectivity, and confirming that physical devices are installed and operating safely.

8. Emergency and Offline Operation

A facility may configure an emergency offline PIN that may be shown to eligible users during certain hub or service failures. Authorized users must protect emergency credentials and use them only for their intended facility access purpose. SoberAuth does not guarantee that a lock will unlock or relock, that a command will be received, or that an event will be recorded immediately. SoberAuth is not an emergency response service, and organizations must not rely on it as their only method of physical access or safety response.

9. Emails, Push Notifications, and Automated Calls

• SoberAuth may send account, membership, security, and operational emails.
• With permission, SoberAuth may send push notifications about facility, hub, lock, battery, background process, and alert conditions.
• SoberAuth may place automated or prerecorded voice calls to authorized escalation contacts when a critical alert is not acknowledged.

These communications are operational and are not advertising or telemarketing. Frequency varies based on facility events, and carrier calling or data charges may apply. SoberAuth does not currently send SMS or MMS messages. Disabling communications may prevent receipt of urgent alerts or may make a user unsuitable for an assigned escalation role.

10. Acceptable Use

You may not:

• Use SoberAuth for an unlawful, fraudulent, abusive, or unauthorized purpose.
• Access another user, organization, facility, test, video, location, device, alert, or record without authorization.
• Manipulate breath tests, verification media, location, access events, device status, alerts, or activity records.
• Interfere with, probe, overload, bypass, or defeat authentication, authorization, or other security controls.
• Introduce malicious code or use automation that disrupts SoberAuth, a connected hub, or another user.
• Copy, scrape, resell, sublicense, reverse engineer, or create derivative works from SoberAuth except where applicable law expressly permits it.

11. Privacy, Retention, and Deletion Requests

Our Privacy Policy explains the information SoberAuth collects, how it is used and shared, current retention periods, and how users may request deletion of personal information. A deletion request may require identity verification and coordination with the participating organization and may be limited when retention is reasonably necessary for security, legal compliance, dispute resolution, or enforcement of these Terms.

12. Beta Features and Service Changes

Features identified as beta, preview, pilot, or prerelease may be incomplete, may contain errors, and may change or be discontinued. We may add, modify, suspend, or discontinue features, integrations, supported devices, or portions of SoberAuth. Organizations should evaluate their configuration and workflows before relying on them operationally.

13. Availability and Maintenance

Scheduled maintenance, server or internet interruptions, local network problems, hub disconnection, depleted batteries, weak device signals, outages involving third parties, or circumstances beyond our control may delay or prevent access operations, alerts, calls, record processing, or other functionality. We do not guarantee uninterrupted availability or operation free of errors.

14. Intellectual Property

SoberAuth and its licensors retain all rights in the software, website, applications, branding, documentation, workflows, and related materials. Subject to these Terms, authorized users receive a limited, revocable, nonexclusive, nontransferable right to use SoberAuth for its intended purpose.

15. Suspension and Termination

A participating organization may change or end a user's membership. SoberAuth may restrict or suspend access when reasonably necessary to secure the platform, protect users, investigate misuse, comply with applicable U.S. law, address nonpayment, or enforce these Terms. Provisions that should reasonably survive termination will remain effective.

16. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOBERAUTH IS PROVIDED "AS IS" AND "AS AVAILABLE." SOBERAUTH DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. WE DO NOT WARRANT A PARTICULAR ACCESS OUTCOME, DELIVERY OF EVERY EMAIL, NOTIFICATION, OR CALL, OR THE ACCURACY OR AVAILABILITY OF HARDWARE OR SERVICES FROM THIRD PARTIES.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOBERAUTH AND ADVANTAGE RECOVERY SERVICES LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO SOBERAUTH OR PRODUCTS FROM THIRD PARTIES. THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE STATE OF TEXAS AND DO NOT LIMIT OR EXCLUDE LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED UNDER TEXAS LAW.

18. Changes to These Terms

We may update these Terms as SoberAuth changes or as legal requirements evolve. We will post the revised Terms and update the date above. Continued use after the effective date means you accept the revised Terms, except where additional notice or consent is required by law.
